1.ABOUT ARTFITNESS
1.1ArtFitness is the trading name of Arturas Bingelis, a sole trader.
In these Terms:
“ArtFitness”, “we”, “us” and “our” mean Arturas Bingelis trading as ArtFitness.
“Client”, “you” and “your” mean the individual purchasing or participating in ArtFitness services.
1.2ArtFitness provides in-person personal training at agreed locations in London and separate online coaching services for clients who train independently at home or in their own gym. Where appropriate and agreed in advance, other training arrangements may also be available outdoors, at a client’s home or at another suitable agreed private location.
1.3Training may take place:
in commercial gyms or other agreed fitness facilities;
outdoors, including parks and suitable public spaces;
at the client’s home or another agreed private location; or
online by video or another agreed remote method.
1.4ArtFitness does not operate a private training studio.
1.5Public contact details are:
Email: hello@artfitness.co.uk
Website: artfitness.co.uk
Location: London, United Kingdom
1.6Where required by UK consumer law, ArtFitness will provide the client with its full geographical business/correspondence address and any other legally required pre-contract information before payment is taken.
1.7The free consultation offered by ArtFitness is a non-exercise introductory conversation and does not create an obligation to purchase training.
1.8The free 15-minute consultation is available once per person and is intended for prospective clients. Submitting a consultation request does not create a confirmed appointment. ArtFitness may decline duplicate, abusive, automated or fraudulent requests. Any additional complimentary consultation may be offered at ArtFitness's discretion.
2.SERVICES AND TRAINING LOCATIONS
2.1The proposed training location must be discussed and agreed with ArtFitness before a paid session or package is purchased.
2.2Purchasing a session or package does not give the client the right to demand training at a location that has not previously been agreed.
2.3Commercial gyms and third-party venues may have their own:
membership requirements;
entry fees;
guest fees;
booking requirements;
personal trainer access rules;
opening hours; and
other facility rules.
2.4Unless expressly agreed otherwise, the client is responsible for their own gym membership, gym access, entry or venue charges. These costs are separate from and are not included in ArtFitness personal-training fees.
2.5Both the client and ArtFitness must comply with the rules of the facility or location being used.
2.6ArtFitness may reasonably propose an alternative location if an agreed location becomes unavailable, unsafe, unsuitable or prohibited.
2.7Where an agreed session cannot be provided because of an ArtFitness-side issue, the provisions in Section 10 apply.

3.1A standard one-to-one personal training session lasts 50 minutes.
3.2One purchased 50-minute session cannot be divided into shorter appointments.
3.3A 4-week coaching package includes the number of separate 50-minute PT sessions stated for the selected weekly frequency: 4, 8 or 12 sessions.
3.4Each 4-week coaching package also includes the ongoing guidance, accountability, progress support and review described on the ArtFitness booking page at the time of purchase.
3.5An in-person 4-week coaching package is not a monthly membership or subscription and does not renew automatically. Each new 4-week block must be separately discussed, agreed and paid for.
3.6An online coaching package provides the level of programming, check-ins, communication, progression and support described for the selected package on the Online Coaching page at the time of purchase. It is delivered for one agreed four-week coaching period and does not renew automatically.
3.7Essential Coaching includes a fully individualised training programme built around the client's goals, nutrition guidance tailored to those goals within ArtFitness's professional scope, WhatsApp or text coaching support, and programme reviews and adjustments.
3.8Plus Coaching includes the Essential Coaching features plus one additional specialist programme chosen from Lower Body, Upper Body or Core, and one private 15-minute coaching and progress call each week.
3.9Complete Coaching includes the Plus Coaching features plus all three specialist programmes — Lower Body, Upper Body and Core — exercise video submissions with technique analysis and personalised feedback, and a detailed food diary review with nutrition feedback.
3.10Exercise video submission, technique analysis, personalised video feedback and detailed food diary review are exclusive to Complete Coaching and are not included in the £69 or £99 packages.
3.11The optional Add-on In-Person PT Session is available exclusively to clients with an active ArtFitness online coaching package. £40 covers one separate 50-minute personal training session at the gym to go through the client's programme, practise exercises and equipment, check technique and build confidence training independently. It is not recurring weekly personal training. Additional one-off sessions may be purchased separately while the online coaching package remains active.
3.12Online coaching clients remain responsible for completing independent training safely, following the agreed programme and guidance, using suitable equipment and surroundings, and telling ArtFitness promptly about relevant changes, pain, injury, illness or difficulty with the programme.
3.13Prices may change for future purchases.
3.14Any price change will not retrospectively increase the price of a session or package that has already been purchased.
4.BEFORE PURCHASING TRAINING
4.1ArtFitness does not operate an unrestricted instant-purchase system.
Before a paid session or package is purchased, ArtFitness and the client must first discuss and agree:
the proposed training location;
general availability;
realistic session times;
the type of training being purchased; and
any other practical arrangements required for training.
4.2Before payment is accepted, the client must also complete the required ArtFitness onboarding process. This includes:
completing the appropriate health questionnaire, pre-exercise screening and PAR-Q process;
providing all requested health information truthfully and accurately;
reviewing and accepting these Terms & Conditions;
reviewing the ArtFitness Privacy Policy;
providing any required declarations and specific consents, including separate explicit health-information consent where applicable;
reviewing any legally required pre-contract information; and
being accepted by ArtFitness for training after the completed information has been reviewed.
Where screening identifies something that may require additional medical advice, referral or clearance, ArtFitness may require appropriate advice or written clearance from a GP or another suitably qualified healthcare professional before training proceeds.
4.3A package purchase does not guarantee any particular recurring day or time unless that arrangement has expressly been agreed with ArtFitness.
4.4Individual appointments remain subject to mutually agreed availability.
4.5ArtFitness may decline to accept a client where this is reasonably necessary because of:
health or safety concerns;
professional scope of practice;
insurance requirements;
venue restrictions;
inability to agree suitable training arrangements; or
another legitimate reason relating to the provision of the service.
5.HEALTH SCREENING, PAR-Q AND MEDICAL CLEARANCE
5.1Health screening is mandatory for every person participating in paid ArtFitness personal training.
5.2Before purchasing training, each client must complete the ArtFitness PAR-Q and any other health screening reasonably requested by ArtFitness.
5.3ArtFitness will review the completed screening and relevant health information before confirming that training can begin. Where screening identifies something that may require additional medical advice, referral or clearance, ArtFitness may require appropriate advice or written clearance from a GP or another suitably qualified healthcare professional before training proceeds.
5.4The client confirms that all health, medical, injury, medication and symptom information provided to ArtFitness is complete and accurate to the best of their knowledge.
5.5Where medical advice or clearance is obtained, this does not automatically require ArtFitness to accept or continue training a client.
ArtFitness may decline, pause, modify or stop training if:
the client’s needs fall outside ArtFitness’s qualifications or professional competence;
the proposed activity is not covered by ArtFitness’s insurance;
ArtFitness reasonably considers that exercise should not proceed;
further medical information is required; or
another legitimate health or safety concern exists.
5.6Clients must promptly tell ArtFitness about any significant change in their health after their initial screening.
This includes, where relevant:
new illness;
new injury;
unexplained symptoms;
new diagnosis;
medication changes;
pregnancy;
medical advice restricting exercise; or
any other change that may affect safe participation.
5.7ArtFitness may require updated health screening and, where appropriate, further medical advice or clearance before further training.
5.8Participation in exercise is voluntary.
The client may stop an exercise or session at any time.
5.9Clients must immediately tell ArtFitness if they experience pain, dizziness, faintness, chest pain, unusual shortness of breath or another concerning symptom.
5.10In an emergency, ArtFitness may contact emergency services and/or the client’s emergency contact and provide relevant information where reasonably necessary to protect the client’s health or life.
6.CLIENT RESPONSIBILITIES
6.1Clients must:
follow reasonable coaching and safety instructions;
communicate honestly about their health and physical condition;
report pain, illness, injury or concerning symptoms;
wear suitable clothing and footwear;
bring suitable hydration where appropriate;
comply with applicable gym, venue or property rules;
behave respectfully towards ArtFitness, other clients, gym staff and members of the public; and
take reasonable care of their own safety.
6.2Clients must not attend training while intoxicated or under the influence of recreational drugs.
6.3Aggressive, abusive, threatening, discriminatory, harassing or unsafe behaviour will not be tolerated.
6.4ArtFitness may stop or refuse a session where continuing would be unsafe, unlawful, outside ArtFitness’s professional scope or seriously disrupted by the client’s conduct.
6.5Where a session cannot continue because of circumstances reasonably within the client’s control, the session may remain chargeable, subject to applicable law.
7.EXERCISE RISK AND RESULTS
7.1Physical exercise involves inherent risks.
These can include:
fatigue;
muscle soreness;
strains;
sprains;
falls; and
other exercise-related injuries.
7.2Different training locations may create additional risks, including gym equipment, outdoor surfaces, weather, other park users, household hazards or the limitations of online supervision.
7.3ArtFitness will provide its services with reasonable care and skill.
7.4Clients accept the ordinary risks associated with exercise that remain despite appropriate screening, coaching and reasonable safety precautions.
7.5ArtFitness does not guarantee a specific result.
This includes any guaranteed:
weight loss;
muscle gain;
strength increase;
change in body shape;
improvement in fitness score; or
particular result within a specific timeframe.
7.6Results depend on factors including attendance, effort, recovery, lifestyle, health and adherence to training.
8.SESSION AND PACKAGE VALIDITY
8.1A Single PT Session purchase must be used within 1 calendar month of the purchase date unless another arrangement is agreed in writing.
8.2An in-person or online 4-week coaching package is intended to be delivered during the agreed four-week coaching period beginning on the agreed start date.
8.3In-person clients are responsible for arranging and attending package sessions within the agreed four-week coaching period. Online coaching clients are responsible for completing their independent training, check-ins and any included calls within that period.
8.4Rescheduling a session does not automatically extend the agreed four-week coaching period.
8.5In-person sessions, online coaching calls, check-ins or other time-limited support that remain unused after the agreed coaching period normally expire and cannot be carried forward, subject to statutory rights and the cancellation provisions in these Terms.
8.6ArtFitness may choose, at its discretion, to agree an extension or alternative arrangement in an individual case.
8.7An exception made for one client or on one occasion does not create an entitlement to the same exception in another case.
8.8A new 4-week block is arranged separately and does not begin or renew automatically.
9.CLIENT CANCELLATIONS, RESCHEDULING, LATENESS AND NO-SHOWS
9.1Clients must provide at least 24 hours’ notice to cancel or reschedule a booked session without losing that session.
9.2Where less than 24 hours’ notice is provided, the session will normally:
be charged in full; or
be deducted in full from the client’s package.
9.3A failure to attend a booked session without sufficient notice is treated as a no-show and the session will normally be charged or deducted in full.
9.4ArtFitness reserves the discretion to waive or reduce a late-cancellation charge in exceptional circumstances.
9.5Any discretionary exception does not create a right to the same treatment on a future occasion.
9.6If a client arrives late, the session still ends at the originally scheduled finishing time.
9.7Client lateness does not extend the session.
For example, arriving 10 minutes late for a 50-minute session normally leaves 40 minutes of the original appointment available.
9.8Arrival 20 minutes or more after the scheduled start time may be treated as a no-show.
9.9ArtFitness may refuse to begin a significantly shortened session where there is insufficient time to provide appropriate preparation and training safely.
10.CANCELLATIONS BY ARTFITNESS
10.1If ArtFitness cancels a booked session, the client may choose either:
to reschedule the affected session without charge; or
to receive a credit or refund for that affected session.
10.2If an ArtFitness cancellation occurs close to the expiry of a package, ArtFitness will either:
provide a reasonable extension for the replacement session; or
provide an appropriate credit or refund for the affected session.
10.3ArtFitness is not automatically required to provide an additional free compensation session because an appointment was cancelled.
10.4ArtFitness may choose to provide an additional goodwill gesture at its discretion.
10.5ArtFitness may need to cancel, relocate or reschedule because of circumstances including:
illness;
emergency;
unsafe weather;
gym or venue closure;
equipment failure;
transport disruption;
online technical failure; or
another circumstance outside reasonable control.
11.REFUNDS
11.1This section describes the normal ArtFitness commercial refund policy. It does not remove or reduce statutory consumer rights.
11.2Where ArtFitness agrees or is legally required to refund the unused portion of a 4-week coaching package, the calculation will take account of the package price paid and the sessions and coaching services already provided.
11.3Where legislation requires a particular refund calculation, the legally required calculation will apply.
11.4No normal refund is due for:
sessions already provided;
coaching support already provided;
valid late-cancellation charges;
valid no-show charges; or
sessions that have expired.
This is subject to any statutory rights that cannot legally be excluded.
11.5An unused Single PT Session purchase is normally intended to be used or rescheduled within its validity period rather than refunded, unless ArtFitness agrees otherwise or applicable law requires otherwise.
11.6Any refund for couples or small-group training will be considered according to the service and price agreed with the participants, the services already provided and applicable law.
12.STATUTORY 14-DAY CANCELLATION RIGHTS
12.1Where applicable UK consumer law gives a client a statutory cancellation right for a service contract entered into at a distance or away from business premises, that right applies regardless of anything in these Terms.
12.2An eligible consumer will normally have 14 days from the day after the contract is entered into to cancel without giving a reason.
12.3If a client wants ArtFitness to begin providing a paid service before the 14-day cancellation period has ended, ArtFitness will obtain a clear express request for early commencement. The request will use wording to this effect:
“I request that ArtFitness begins providing my coaching service before the end of the 14-day cancellation period. I understand that if I cancel during that period, I may be required to pay for services already provided before cancellation.”
12.4Where a client has made that express request and then validly cancels during the cancellation period, ArtFitness may retain or charge only a reasonable proportion of the agreed price reflecting services actually supplied before cancellation, where the law permits.
12.5Services actually supplied may include, where applicable, assessment of onboarding information, individual programme preparation or creation, coaching already delivered, programme reviews, coaching calls, coaching support and other individual work already completed for that client.
12.6ArtFitness will not apply an automatic whole-week charge merely because a coaching week has begun, or a fixed programme-creation cancellation fee, unless that amount lawfully and proportionately reflects services actually supplied in the individual case.
12.7Where a single 50-minute service has been fully performed during the statutory cancellation period, the statutory cancellation right relating to that completed service may be lost only where the legal requirements for early performance and acknowledgement have been satisfied.
12.8After the statutory cancellation period has ended, a four-week coaching package is a committed coaching period and unused coaching time is not normally refundable, subject always to statutory rights and any alternative arrangement expressly agreed by ArtFitness.
12.9A client wishing to exercise an applicable statutory cancellation right may contact hello@artfitness.co.uk with a clear statement that they wish to cancel. The client does not have to use a particular form if the law permits another clear cancellation statement.
12.10Where required by law, ArtFitness will provide the statutory model cancellation form separately as part of the relevant pre-contract information.
13.PAYMENT
13.1Payment can be made by:
cash;
bank transfer; or
secure card payment via Square.
All three payment methods are equally valid.
13.2Payment is completed before the agreed paid service begins, once your consultation, onboarding and training or coaching arrangements have been agreed.
13.3No payment details are required for the free consultation.
13.4Where a client chooses to pay by card, Square processes the card transaction under Square’s own terms and privacy information. ArtFitness does not receive or store the client’s full card details.
13.5An in-person or online 4-week coaching package is not a subscription and does not renew automatically. Any new 4-week block must be separately agreed and paid for.
14.COUPLES AND SMALL-GROUP TRAINING
14.1Every person participating in couples or small-group personal training must:
be aged 18 or over;
complete individual ArtFitness onboarding;
complete the required PAR-Q and health screening;
provide any medical advice or clearance that ArtFitness reasonably requires after reviewing the participant’s screening; and
be accepted by ArtFitness before participating.
14.2A participant cannot simply be replaced by another person who has not completed ArtFitness onboarding.
14.3If one participant in a couples or small-group booking does not attend, the session may continue with the remaining approved participant or participants.
14.4The full booked session price remains payable.
14.5An absent participant does not automatically convert a couples/group booking into a cheaper service or create a partial refund.
15.NON-TRANSFERABILITY
15.1Personal training sessions, package credits and approved group places are personal to the client or clients for whom they were purchased.
15.2They are non-transferable unless ArtFitness expressly agrees otherwise in writing.
15.3This restriction exists because every participant requires individual onboarding, health screening, any medical advice or clearance identified as appropriate after screening, and individual client records.
16.COMMERCIAL GYM TRAINING
16.1Clients must have valid access to the agreed gym at the scheduled session time.
16.2Unless expressly agreed otherwise, gym membership, access, entry or guest charges are the client’s responsibility. These costs are separate from and are not included in ArtFitness personal-training fees.
16.3Clients must comply with the rules of the gym.
16.4If a session cannot proceed because of a client-side membership, entry or access problem, the normal cancellation/no-show provisions may apply.
16.5If the session cannot proceed because ArtFitness does not have required permission or because of another ArtFitness-side issue, Section 10 applies.
17.OUTDOOR TRAINING
17.1Outdoor training is subject to suitable weather and environmental conditions.
17.2ArtFitness may relocate, alter or reschedule outdoor training where conditions are reasonably considered unsafe.
Examples include:
severe weather;
lightning;
ice;
flooding;
high winds; or
another significant environmental hazard.
17.3Clients must wear suitable clothing and footwear and follow reasonable safety instructions relating to the environment.
18.TRAINING AT A CLIENT’S HOME OR PRIVATE LOCATION
18.1The client must provide a reasonably safe and suitable area for exercise.
18.2The area must provide sufficient space for the agreed activity.
18.3Clients should inform ArtFitness of relevant hazards.
18.4Pets, children, loose objects or other foreseeable obstructions should be kept away from the active training area where necessary for safety.
18.5ArtFitness may modify or stop training if the environment is unsafe.
18.6If an unsafe condition within the client’s control prevents the session from proceeding, the session may remain chargeable, subject to applicable law.
19.ONLINE TRAINING
19.1Clients participating online are responsible for:
having a suitable internet connection;
having a suitable device;
providing a safe exercise area; and
ensuring any equipment they use is in safe working condition.
19.2Where reasonably possible, clients should position their camera so ArtFitness can adequately observe the movements being coached.
19.3Online personal training has limitations compared with in-person supervision.
19.4If a significant technical failure on the ArtFitness side prevents the session from being substantially delivered, Section 10 applies.
19.5Client-side technical problems do not automatically extend the scheduled appointment.
20.PERSONAL BELONGINGS
20.1Clients remain responsible for personal belongings brought to training.
20.2ArtFitness is not responsible for loss, theft or damage to personal belongings unless the loss or damage is caused by ArtFitness failing to exercise reasonable care.
21.PHOTOGRAPHY, VIDEO AND TESTIMONIALS
21.1ArtFitness may offer progress photography or video as part of coaching.
21.2Purchasing personal training does not automatically give ArtFitness permission to publicly use a client’s image, video, testimonial or transformation.
21.3Separate consent will be obtained before identifiable client material is used for:
advertising;
social media;
website content; or
other promotional purposes.
21.4Refusing marketing photography or video consent does not prevent somebody from becoming an ArtFitness personal training client.
22.INTELLECTUAL PROPERTY
22.1ArtFitness owns or licenses its:
branding;
website content;
training materials;
programme templates;
graphics;
written materials; and
original business content.
22.2Material supplied to clients is normally for their personal, non-commercial use.
22.3ArtFitness material must not be commercially reproduced, copied, sold or distributed without prior permission.
22.4Clients retain ownership of their own personal information, images and personal records subject to applicable law.
23.LIABILITY AND CONSUMER RIGHTS
23.1ArtFitness will provide its services with reasonable care and skill.
23.2Nothing in these Terms excludes or limits liability where doing so would be unlawful.
This includes liability for:
death or personal injury caused by negligence;
fraud or fraudulent misrepresentation; and
statutory consumer rights that cannot legally be excluded.
23.3ArtFitness is not responsible for injury or loss caused by matters such as:
a client deliberately or negligently failing to follow reasonable safety instructions;
material health information the client failed to disclose;
unsafe client-owned equipment;
an unsafe client-controlled training environment; or
circumstances outside ArtFitness’s reasonable control,
except to the extent that ArtFitness is legally responsible.
23.4ArtFitness is not responsible for losses that were not reasonably foreseeable when the contract was made.
23.5ArtFitness services are provided to consumers for personal use.
ArtFitness is therefore not responsible for business-related losses such as lost profit, lost revenue or loss of commercial opportunity.
24.INSURANCE
24.1ArtFitness will maintain insurance appropriate to the fitness services it provides.
24.2ArtFitness will comply with relevant conditions of its insurance cover.
24.3Insurance does not remove or reduce either party’s legal rights or responsibilities.
25.PRIVACY AND DATA PROTECTION
25.1ArtFitness processes personal information, including health information, in accordance with applicable UK data-protection law.
25.2Further information is contained in the ArtFitness Privacy Policy available on the ArtFitness website.
25.3The Privacy Policy explains:
what information ArtFitness collects;
why it is collected;
how it is used;
how it is stored;
who it may be shared with;
how long it may be retained; and
the client’s data-protection rights.
26.COMPLAINTS
26.1If a client is unhappy with an ArtFitness service, they should contact:
as soon as reasonably possible.
26.2ArtFitness will aim to consider and respond to complaints fairly.
26.3Nothing in this section prevents a client from seeking independent advice or exercising their statutory rights.
27.ENDING THE CLIENT RELATIONSHIP
27.1A client may stop training at any time, subject to the payment, cancellation, expiry and refund terms contained in these Terms.
27.2ArtFitness may suspend or end the client relationship where there is a reasonable and proportionate reason to do so.
Examples include:
serious or repeated abusive behaviour;
unsafe conduct;
non-payment;
dishonesty in health screening;
repeated material breaches of these Terms;
failure to obtain any medical advice or clearance required after screening; or
the client’s needs falling outside ArtFitness’s professional scope.
27.3Where ArtFitness ends the relationship for reasons that are not caused by a client breach, unused paid services that ArtFitness will no longer provide will be dealt with fairly, including an appropriate refund or credit.
27.4Where the relationship ends because of a serious client breach, ArtFitness may deduct any sums lawfully due before calculating any remaining balance.
28.CHANGES TO THESE TERMS
28.1ArtFitness may update these Terms for future bookings and purchases.
28.2Updates may be made to reflect changes in:
services;
prices;
business practices;
technology;
insurance requirements; or
applicable law.
28.3An update will not normally retrospectively change the essential price or service rights attached to an existing paid purchase.
28.4Where an existing arrangement must change because of law, health, safety or another legitimate reason, ArtFitness will communicate the change clearly and preserve any mandatory client rights.
29.SEVERABILITY AND WAIVER
29.1If part of these Terms is found by a court or competent authority to be unlawful or unenforceable, the remaining provisions will continue to apply so far as legally possible.
29.2If either ArtFitness or the client does not immediately enforce a provision of these Terms, that does not automatically mean the right to enforce it later has been waived.
30.GOVERNING LAW
30.1These Terms are governed by the laws of England and Wales.
30.2Nothing in these Terms removes any mandatory legal protection that applies to a consumer.
30.3If a consumer lives elsewhere within the United Kingdom, they retain any mandatory consumer protections and court rights that applicable law gives them in their home jurisdiction.
31.ONLINE COACHING
31.1Each online coaching package covers four coaching weeks. Online Coaching begins on a Monday, and the agreed start date must normally be within three weeks of purchase.
31.2Clients should submit the information required for their weekly review by Tuesday at 1:00pm for the previous coaching week. For example, information relating to Week 1 is submitted by 1:00pm on Tuesday of Week 2.
31.3Depending on the selected package and what has been agreed, the weekly information may include activity information, nutrition or eating information, progress information, relevant training information and exercise videos where video review is included in the package.
31.4Weekly reviews and included coaching calls normally take place on Wednesday or Thursday at the agreed time. Information received after Tuesday at 1:00pm is not guaranteed to be reviewed that week. Missed or late submissions do not accumulate and do not create additional reviews later.
31.5After Week 4, the client remains entitled to the review relating to that final coaching week even if they do not renew. Week 4 information should be submitted by Tuesday at 1:00pm following the end of the package, and ArtFitness will provide the corresponding final review on the agreed Wednesday or Thursday.
31.6Where a package includes a weekly coaching call, the call lasts approximately 15 minutes and normally takes place on Wednesday or Thursday at an agreed time.
31.7A client may request to rearrange an included call with at least three hours’ notice. Any replacement time is subject to ArtFitness availability. ArtFitness will make reasonable efforts to offer another convenient time, but cannot guarantee the client’s requested alternative. If a client misses the agreed call without sufficient notice, ArtFitness may try again later if availability allows, but a replacement is not guaranteed. Missed calls do not accumulate or roll over.
31.8If ArtFitness cancels or needs to rearrange an included coaching call, ArtFitness will arrange another mutually convenient time as soon as reasonably possible. The client will not lose the call because ArtFitness was unavailable.
31.9Coaching-support messages may be sent between 8:00am and 8:00pm daily. ArtFitness will normally respond within 24 hours and will often respond sooner, but the service does not promise immediate replies, constant availability or 24-hour coaching support.
31.10One pause may be approved during each four-week online coaching package. A pause must be for a minimum of one complete week and a maximum of two complete consecutive weeks. It cannot be divided into individual days or separate pauses. Clients must normally give at least seven days’ notice. The package end date will be extended by the approved pause period.
31.11During an approved pause, coaching reviews, coaching calls and programme-management activity are paused. When coaching resumes, normal weekly reporting continues. Information relating to the last active coaching week before the pause should be submitted by the normal Tuesday 1:00pm deadline after coaching resumes, with the corresponding review on Wednesday or Thursday.
31.12Online Coaching does not renew automatically unless ArtFitness and the client specifically agree otherwise. To continue into another four-week block, the next package should normally be purchased at least seven days before the current package expires so progress can be reviewed and the next block prepared.
31.13Where renewal is completed in time, the next block will normally continue from the next appropriate Monday unless another arrangement is agreed. If renewal is purchased with fewer than seven days remaining, ArtFitness will make reasonable efforts to avoid interruption, but continuity is not guaranteed and the next block may be delayed by up to one week.
31.14Clients complete independent workouts without ArtFitness being physically present or directly supervising the training environment. Clients must provide complete and accurate onboarding and health information, report relevant changes, follow the agreed programme and guidance, exercise within their abilities, use suitable and safe equipment, follow applicable gym, equipment and manufacturer instructions, and keep their training environment reasonably safe.
31.15Clients should ask ArtFitness for clarification rather than guess how an unfamiliar exercise should be performed. They must stop exercising if they experience significant pain, dizziness, unusual symptoms or another concerning reaction and seek appropriate medical advice where necessary.
31.16Exercise involves inherent risks, including when performed independently. ArtFitness will provide its coaching services with reasonable care and skill. Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for ArtFitness’s own negligence where the law does not permit its exclusion.
31.17Nutrition support within Online Coaching is limited to general nutrition guidance, healthy-eating guidance, eating-habit support and fitness-related lifestyle guidance within ArtFitness’s professional scope.
